The Chinese government aims to build a “harmonious society” as a way of overcoming this. It is urging the Chinese people to pursue“citizens' participation”as an example of “harmony rights” (the right to create a harmonious and equal society), and is asking for constructive suggestions on nation building. But although the people have presented proposals on “abolishing the system of correction through labor”,“amending the Code of Criminal Procedure” and others with a view to protecting human rights, the government has rejected these. This is because the people of China are merely the objects of “leadership by the Communist Party of China”, and have yet to establish their status as subjects of a country governed by the rule of law. The active “leadership” of the Communist Party towards the judiciary, legislature and administration gives the impression that the  “Party” and the “State” are one and the same thing. There are fears that this could be a reincarnation of the“Law to Secure the Unity of Party and State”(Gesetz zur Sicherrung der Einheit von Partei und Staat,1933) in Nazi Germany. The Nazi system of law has since been called “Gesetzliches Unrecht” (legalized injustice), as it deliberately denied human equality and human rights; it led to the “White Rose” resistance movement that demanded “freedom”.
